BREAKING THE SILENCE; PAKISTAN’S LEGAL BREAK THROUGH AGAINST TORTURE AND CUSTODIAL DEAHTHS

Abstract:

Torture, custodial death and custodial rape are serious violations of human rights and civil liberties, usually perpetrated within detention facilities, arrests and police custody by or with the consent of public officials. These abuses, which consist of physical damage, mental trauma, illegal deaths and sexual violence, undermine regulatory guideline and disproportionately affect marginalized women and communities. In reaction, Pakistan promulgated the law of torture and custody (prevention and punishment) Act, 2022 (Act 2022)1, a historical legislative measure that criminalizes these acts and aligns domestic laws with global human rights standards. The law provides unambiguous definitions, punitive measures, and investigative approaches to curb abuses and ensure the victims’ redressal.
